Withholding or otherwise repurposing the pay of Senators and Representatives is generally understood to be prohibited by the 27th Amendment: "No law, varying the compensation for the services of the Senators and Representatives, shall take effect, until an election of Representatives shall have intervened." There are several reasons for this, among them the desire to avoid the use of compensation (lower of higher) as a political lever. Congressional pay is funded by “Mandatory Spending,” not annual appropriations, hence stopping their pay would result in “varying’ their compensation. Nothing stops them from voluntarily repurposing their compensation or returning it to the treasury—which some have done.
