In fact, there was no proposed rule.  In December DOT submitted an ‘Advanced 
Notice of Proposed Rulemaking’ not a NPRM.  In December they formally said they 
wanted to craft a rule and asked what should be in it.

 

The Biden administration waited until after the election to do this – even 
though President Biden had said he wanted it a year and a half earlier.

 

And they probably lacked the legal authority for it, which is why the Biden 
administration had asked Congress to pass it in legislation.

 

This was never going to happen.  The Trump administration said back in 
September they expected to rescind the ‘advance’ NPRM.

 

That’s all separate from whether it’s a good idea to provide all travelers with 
airline delay insurance, and require that it be bundled with the purchase of a 
ticket.

DOT is pulling back a proposed rule to require airlines to pay cash 
compensation for significantly delayed flights.  Article discusses other 
consumer protection potential reversals.

 

I figure this should stir some debate within the Mifnet.
