Sounds like the index generated by MITAB has some problem in it. I'd suggest that you file a bug at http://bugzilla.maptools.org/enter_bug.cgi?product=MITAB and attach a copy of the MIF/MID file to reproduce this, a copy of the TAB dataset produced by MapInfo (with the working index) and a description of the query that fails. I'm not sure when I'll be able to look into this issue, but at least the problem will be documented and ready to be investigated. Note that if this issue is critical for you then you can raise its priority by offering to fund the fix (just contact me off-list to discuss that possibility).
