conditional require of Apache::Constants, answer

Ok,

I figured it out with one last suggestion from a friend:
BEGIN
{
 if (exists $ENV{MOD_PERL})
 {
   require Apache::Constants;
   import Apache::Constants qw(:common :http);
 }
}

That is the ticket!
