I have encountered this before, but it has never been a problem. If the link should click through to another page, it will have an href. If it will initiate JavaScript then you can set href="#" and preventDefault() within the callback. I prefer to us the HTML5 doctype (<!DOCTYPE html>) rather than to use something else for the sake of not handling links properly...
