I've had this happen, once only it was for a really nice poster at a third of the price I had put in a snipe for. Seller made many excuses and said he would not be selling. I filed the seller would not send out form, you can't really force the person to sell and ebay won't really do anything either, just a bad mark in his ebay book - probably.
In the end I didn't even neg him it seemed punitive and pointless. Still after the poster though.
