That's definately a strategy :-) It may be that the
MoFo people can structure it such that suing means
nothing, and another organisation pops up to take
its place. This could be done by creating a trust
to hold the code, and "appointing" a company to
provide admin support on contract, for example.
As long as whoever creates the root list is careful
not to be named, that would maybe be a way forward.
Another way is to leave the US. That can be pretty
complicated, and I only suggest it as a theoretical
option.
A further way is to get cozy with the nastiest,
biggest law firm in town. Offer them free browsers
or something so you can plaster their name all over
the site.
