it is a fixed, but arbritrary bitrate.  No reason to use it
unless you want an exact bitrate which is not one of the
supported CBR bitrates.  Also, if you want to live on
the bleeding edge of the standard, you can use it to achieve
bitrates > 320kbs.  LAME will encode/decode up to 560kbs free format.  
Xing based decoders (like freeamp) seem to handle up to 440kbs.
