My Muse version in Debian etch is 3.03.8-1 and when I try to publish the TOC of a page with the <contents> tag the html file generated contain only the list tag "dl" without "li" elements.
The documentation of the variable muse-publish-generate-contents says Documentation: Non-nil if a table of contents should be generated. If non-nil, it is a cons cell specifying (MARKER . DEPTH), to tell where the <contents> was seen, and to what depth the contents were requested. Defined in `muse-publish'.
