I do not think the Muse 1.0 team (Pubscribe 1.x team) got around to 
implementing preconditions - if you look at the source:

notice that the parameter representing the precondition (XPathFilter xf) 
is never used in the body of the method, while TopicFilter is. So the 
operation accepts preconditions but doesn't apply them.
