I do not think the Muse 1.0 team (Pubscribe 1.x team) got around to implementing preconditions - if you look at the source:
http://svn.apache.org/viewvc/webservices/pubscribe/trunk/src/java/org/apache/ws/notification/pubsub/Subscriber.java?revision=326974&view=markup notice that the parameter representing the precondition (XPathFilter xf) is never used in the body of the method, while TopicFilter is.
