If I touch the file, the error is for mysql.000002, then mysql.000003. What would be causing this, and how should I go about fixing it? Any help would be much appreciated, thanks.

OS error code  13:  Permission denied

It would seem that /var/log/mysql.xxx isn't using the correct permissions

For what its worth, you should be logging to /var/log/mysql/foo, and make sure that /var/log/mysql can be read/written to by the mysql server
