The following NetWarriors summary is based on reports from the informal
debates taking place on the floor of the Intersessional Working Group
meetings taking place in Geneva, and shows where the state governments have
said they stand in regard to the various articles under discussion. VP

governments also.  They should understand that the world is watching.

Canada-Include provision recognizing the primary importance of individual
rights. 
Japan-Add "applicable" before "international human rights law."  
China-Change first paragraph, line 3 to "Indigenous peoples have the right
to the full and effective enjoyment of all human rights and fundamental
freedoms recognized in the Charter of the United Nations, the Universal
Declaration of Human Rights and other international human rights laws."  
Russian Federation-Put a full stop (period) after the words "fundamental
freedoms." 
New Zealand-Amend to include individual as well as collective rights. 

State which does not accept as is 
France-Supports UK but says necessary to avoid clashes between individual
and collective rights as regards Article 1.

US-Human rights and fundamental freedoms constitute individual rights and
not group rights. 
The Netherlands-Problem for Articles 1 and 2 not people vs peoples, but
clash of individual vs group rights.  Individual rights most important.

States prepared to accept as written 

Finland 
Angola 

States which want to amend and/or do not accept as is 
Canada--Amend to reflect, "While respecting the rights of others." 
US--Text must be more precise; concerned about open-ended obligation for
restitution 
Brazil--Has problems with language; in Brazil, archaeological sites belong
to the state. 
El Salvador--Similar problems as Brazil. 
Japan--Does not support restitution.  Compensation an internal matter. 
Australia--Wants clarification on intellectual property; opposes restitution. 
New Zealand--Article wording must be consistent with Treaty of Waitangi
because current scope is to wide. 
Switzerland--Opposes restitution as written; says should be aligned with
relevant international instruments 
France--Wants more precise language re: restitution 

UK--Wants customs and traditions to be practiced in accordance with
international human rights standards, similar to Article 33 
Russian Federation--Wants deletion of past, present, and future.
Restitution could be placed in a separate article 
Norway--Must be consistent with International Property Law.  Wants
clarification on restitution 
Denmark--Clarify certain elements in the last part of the Article
