Court blocks injunction; state can ticket tribal tags

A federal appeals court temporarily blocked a judge's order against the 
state enforcing its laws against members of the Prairie Band Potawatomi 
who drive off the reservation with tribal tags.

The ruling Wednesday by the 10th U.S. Circuit Court of Appeals in Denver 
has no impact on the status of the tribe's lawsuit before U.S. District 
Judge Dale Saffels.

It blocks enforcement of the Saffels' injunction until the appeals court 
can rule on the merits of that order. Meanwhile, no hearing date has 
been set on the lawsuit.

In September, Saffels issued an order preventing the state from 
enforcing its vehicle registration laws against Potawatomi members who 
put tribal plates on their vehicles until the legal issues are resolved. 
The state appealed that order.

"It is the nation's belief that it eventually will prevail on the merits 
of the issue, regardless of the state's ability to arrest tribal members 
pending the outcome of the case," said tribal attorney David Prager III.

The tribe wants the state to recognize the tags it has issued to members 
living on the tribe's 121-square-mile reservation in Jackson County. The 
tribe sued after a member received a ticket for driving on a state 
highway with a Potawatomi tag.

Defendants are Karla Pierce, secretary of revenue; Sheila Walker, 
director of vehicles for the Department of Revenue; and Col. Don 
Brownlee, superintendent of the Kansas Highway Patrol.
