I am still trying to fully understand this issue and I've reached a point where I think I was observing the problem discussed in http://ietfreport.isoc.org/all-ids/draft-ananth-tsvwg-timewait-00.txt a) TIME-WAIT assassination of the server TCB. As per RFC 793, if the SYN is in window, the server would respond with RST. If the SYN is outside the window, an ACK would be sent back which would solicit an RST back.
