Actually, it's looks like it's the other of two scenarios.
Instead of it being a company that's just out to kill Linux,
it's a company that's making relatively factual statements that
Linux haters are perverting and taking out of context.
Case in point, these people made the patent statement, and
then Ballmer took it, perverted it, and then tried used it
against Linux. These guys published the following response,
essentially saying that while their claims were accurate, it's
conclusion is the opposite of Ballmers:
"The bottom line is there___s no reason to believe that Windows,
Solaris, AIX, or any other functionally similar operating system
has any less risk of infringing patents than does Linux."

This is only true if they have evidence that these patents are being
violated. If they don't they're using FUD to drum up business.
