As far as I understood JOSM is only running a generic sanity check (like: are all ways aligned in the direction from-via-to). Any "error" that JOSM or JOSM plugins are reporting are to be treated rather as: "You should double-check this, it could be wrong.". I'd conside your example and the tagging you suggested to be valid. I don't see a necessity for the via way direction to be enforced going from the "from" to the "to"-way.
