As happens - I solved the problem with 10 mts of posting it !.
filter formats only work on specific types of data
Waypoints, Tracks or Routes
Polygons only work with waypoints
not sure why but that's the way it is.

as the wiki says
"Gpsbabel lets you filter your results. It can modify tracks, routes and
waypoints, not all of the filters can handle all three dataforms, check
with the gpsbabel capabilities page before trying"
