In the state of California it IS legal but the rider must not go more than 10 mph faster than the cars they are passing and traffic must not be going over the posted speed limit. I split lanes all the time in heavy traffic and I usually do well... I understand that it juristically increases my chances of getting into an accident and I have been in a few accidents while splitting lanes over the past 12 years but I don't push my luck and I don't split lanes at high speeds. There are people that will split lanes at reckless speeds... usually the same idiots that try to do stunts out on the highway and/or are just reckless riders/drivers in general. Anyway those are the guys that give motorcycles a bad reputation because those are the guys that usually kill themselves and or somebody else.
In california riders like to split lanes between the carpool lane and the fast lane... this is probably the safest and easiest place to split lanes on the highway but this is where the California Highway Patrol CAN (but probably won't) give you a citation. You are ok as long as you SHARE the carpool lane and do not cross or ride on the double yellow line. And of course do not exceed 10 mph faster than traffic and do not exceed the posted speed limit. For example traffic is going 20mph you can pass going 30mph or if the speed limit is 25mph you may pass going 25mph. Even though this is California state law these are probably good rules to go by no matter where you are if you're going to split lanes.
