I wasn't loading it myself. When I was trying to find out how exactly it gets
loaded
I noticed that I have a really old build of emacs 23 (2007). I checked out the
latest
version from CVS and built it and nXhtml seems to load without errors for now
so I am
marking this is as "solved".
