Yes limiting the BSD via the ToS is what is really disgusting on the 
part of mathworks probably has no legal basis. But if we as Octave 
developers give legitimacy to mathworks claim then they might be used in 
court for any violation of their ToS that put code directly downloaded 
from mathcentral into Octave.
