This e-mail proposes an amendment to Article IX of the Constitution. The current article reads:
> This Constitution and its bylaws may be altered, amended, added to, > or repealed by an affirmative vote of a majority of the Members of > record, provided that the proposed deletions and additions, when > applied to the Constitution, will result in a new Constitution that > remains in complete compliance with the OpenSolaris Charter. The > complete text of the proposed deletions and additions must be > delivered in a notice by electronic mail to the Members no less than > ten (10) days prior to any vote on said deletions and additions. The process in Article IX provides insufficient guidance for handling a situation where a number of amendments are being devised for the Constitution. I propose that amendments shall only be sent to the membership for voting if they have passed the Majority voting requirement in article 8.4. I also propose that amendments only be allowed during the Annual or Special Meeting. Allowing amendments during a Special Meeting will allow out-of-cycle amendment where necessary, so that essential amendments don't need to wait for a year to be considered. Thus, Article IX should be amended to read: "This Constitution and its bylaws may be altered, amended, added to, or repealed by an affirmative vote of a majority of the Members of record during Annual and Special meetings as defined in 5.2 and 5.3, provided that the proposed deletions and additions, when applied to the Constitution, will result in a new Constitution that remains in complete compliance with the OpenSolaris Charter. The complete text of the proposed deletions and additions must: * be approved within an active OpenSolaris Community Group using the Majority voting rule in article 8.4 prior to being delivered to the full Membership for adoption. * be delivered in a notice by electronic mail to the Members no less than ten (10) days prior to any vote on said deletions and additions. " This Amendment has been discussed in the #opensolaris-meeting IRC channel and has been found generally appropriate for consideration. I request that this amendment be placed before the membership as part of the 2008 OGB elections and General Meeting, and this e-mail is notification under the present Article IX process.
