I don't think it's helpful to take a position on this statement. However, let's think about your last sentence for a moment, in the abstract. If an OGB did believe that a project team were harming the OpenSolaris Community, why should they need to speak with Sun leadership about it? If that project team is actually a part of the OpenSolaris Community, the project's sponsoring Group(s) and/or the OGB would resolve the issue. If the project team is in fact a part of Sun, then it's not an OpenSolaris project team at all and shouldn't be making claims to that effect. The way you've chosen to express this is illuminating. That the OGB seems likely, under present circumstances, to take an action which does indeed include communication with Sun is mainly a result of trademark implications, not a belief that a project team is "out of control" or that Sun is obligated to assist us in some way. But I wonder: if the trademark weren't involved, would you still feel that the OGB would need to engage with Sun to resolve a hypothetical disagreement within the OpenSolaris Community?
