I agree with the first statement.
The second however is false.
As long as the OGF incorporates it will be a legal entity. It doesn't _have_ to be a NPO. WotC could create a wholly owned subsidiary and assign it control. Now while this would solve the legal requirements, many of us (Hi Faustus) would feel that it would give WotC undue control. The only objection I have with Faustus' redirects is his statement that he obtained them to prevent them from being used for commercial purposes and then having a link to his commercial website.
