He hasn't been able to shake the, "But I'm a D&D designer I can do what I want!" mindset And Wizards pretty much lets him get away with it. Although I think he got burned on the Illithid deal.
nah, it's just par for the course--IME *most* OGC, and especially PI, declarations are about of that caliber. And a rather large portion of the creators only make OGC as much as they feel they have to--the only difference here is the choice to (perhaps) claim all OGC element names as PI, rather than just the unique ones.
