I'm no lawyer, and I admit there's some grey area here that defies this simplification, but this lawsuit seems akin to suing Microsoft because Word enables me to write a novel identical to a copyrighted work. City of Heroes can't be held liable because players are able to build a hulking brute superhero, color his skin green, and name him The Hulk.
