A professional who doesn't do his research isn't going to get much latitude
in court. A hobbyist will get more. With the "individual responsibility" defense
it's possible that everyone will just end up having to deal with their own
mistakes alone. Ideally. (If anything involving infringement can be ideal.)

I agree. I just spent three dozen extra words to make sure my point was all
cloudy and vague. <grin>
And I think the hobbyist *should* be as careful. It's the option of the
offended party to go easy on a hobbyist. It is not the luxury of the hobbyist to
operate without consequences or ramifications. If the hobbyist wants the same
protections afforded to the professional he'll have to come inside the city
walls and live by the same law.
