There's no trademark on '3rd Edition'. While a consumer might make the 
logical leap of assuming '3rd Edition D&D', there are many, many, games 
which have had a '3rd Edition' -- Champions, Ars Magica, Runequest, and 
Call of Cthulhu all come to mind.
