The fact that all of your comparisons are to items not published under the
OGL (NWN, Master Tools, Player's Handbook) certainly does nothing to
support your claims that the OGL is allowing these people to behave
differently than you would be able to behave under the OGL.  If you want
to be like NWN, Master Tools or PH do what they did - either own all
the material yourself or pay the owner to use the material.

Clearly there are difficulties with software because of the medium, but
really no extra demands are placed on software than paper.  Both have to
clearly identify all the OGC contained, everywhere the OGC appears.  If
the medium makes that more difficult for one, that's a difficulty those
who chose to use that medium are simply going to have to address.
