  As Ryan has stated that it is a WotC assertion and not something backed by 
written law, all one will ever get are "opinions" on this matter. I would 
imagine it much better to get the opinion of an attorney than the opinion of 
most rank-and-file list lurkers. But then, that "opinion" of mine has never 
hindered the many cries of "Well, I'm not an attorney but I think..." so...
