Prior art?

I've heard the term before, just wondering. I would also doubt that WotC
would litigate because you use mind flayers in your product, and they happen
to resemble the octopi headed men mentioned in the Eldritch Wizardry
supplement oh so long, long ago. WotC probably has more important things to
worry about, like people claiming their products as "core" rulebooks, trying
to manufacture videogames using the d20 rules, and other skullduggery.
