If I were an average publisher, not realizing that WotC didn't want AEG to open it, I would look at page 3 and see that they got permition to use it, then look at there PI and see that it wasn't in there. i would then look at there OGC designation, wich is very thurough about what in a chapter is open, see that is was declared open and go ahead and use it. The problem is that they are so thurough about what in each chapter is open content, I would assume that the VP/WP system was open, since at no point do they say WP/VP is not open content. All they say is that the non-open content from starwars was used with permision.
