I have defined some baselayers. So this is not an option for me.

for example this one:
var orthophoto = new OpenLayers.Layer.WMS( 
  "otrhophoto", "wmsurl", { 
    LAYERS: 'RJ_Ortho',
    format: 'image/jpeg' 
  }, {
    isBaseLayer: true,
    transitionEffect: 'resize'
  }
);
