There is a serious problem with copyright infringement on orkut applications. It takes long time for orkut team to process valid DMCA reports and it is fairly easy to copy apps on orkut since app xml url is visible to users. And also seems like orkut similarity check verification for gadgets doesn't work. One example: http://www.orkut.com/Main#AppDirectory?dirFilters=&dirQuery=Wellington+Nunes This guy takes logos of popular apps on orkut, adds "2" - and here we have a new app. If you recognize your logo in this list - please file a DMCA. There are many other examples where "developers" just copy other app xml and republish it on orkut.
