The problem is license incompatibility.
If one can pursuade the driver author to dual licence, then you would
probably be fine (but I am not a lawyer). However, if the author cannot
be so pursuaded, secions of the GPL cannot be complied with when linking
to the Solaris kernal and then distributing the result.
