You are allowed to use OpenSSL commercially as long as you attribute
it to the authors (see the SSLeay and OpenSSL licenses for details).

RSA is patented in the US only.

There are (as far as I know) North American, European and Japanese
patents for RC5 and IDEA and for an obscure DES mode that is
implemented in OpenSSL. You may want to exclude those algorithms if
you are selling your product to any of these regions.

At <URL: http://grouper.ieee.org/groups/1363/patents.html>, there is a
list of patented (and allegedly patented) crypto algorithms.

It should be easy for a patent attorney to find out if any of them
applies to you given the information on that page, but I never heard
of any Chinese patents for these algorithms.
