Hey Ben, IANAL, but from what i know, using any MP3 tool is just fine if you dont ship to more than 300000 users, or so. A substantial amount, anyway. The MPEG-LA (mpegla.com) is one of AFAIK two institutions that manage the "mpeg patent portfolio", and they seem to have this rule.
