I pinged the team about this, and this is what they said:

--
Problem: after test movie in an AIR document that contains ActionScript or 3D, if the test movie window (ADL) is not closed, publish or export movie will result in compiler errors (Multiple constructor definitions found. Constructor may not be defined in <Script/> code.)

Workaround: close the ADL window to set the application back in the working state. Closing ADL window after test movie to avoid the problem.

Never saw this before...and I don't get this error if I publish to AIR1 file using CS3.

What gives here?

Also I can't launch the debugger...get this message
'debugger launch failed debug session will terminate'

Arrrrgh! Please help...
