'Muslims should participate in drafting a Common Civil Code' Send To Friend New Delhi, Feb 26: A retired Muslim judge from Gujarat today asked the community leaders to help drafting a Common Civil Code. "First, let the Code be born and thereafter, on proper consideration, it may be rejected if it turns out to be a demon," (Retd) Judge of Gujarat High Court Justice A S Qureshi said at a seminar organised by Institute of Objective Studies here. "There is strong resistance and a lot of confusion among the Muslims in general about the Common Code," he said, adding "they would do well to adopt a positive and participative attitude and not the negative and obstructive one." Qureshi, however, said the government should not enforce it on communities which do not agree to it. He said "the Code, if and when enacted, it should be made applicable only to those communities and individuals who agrees to it. "If the proposed Code is compulsorily enforced on the unwilling groups of people, it will violate the constitutional provisions guaranting freedom of religion," Qureshi said. He also said the Code should not be an extension of the principles of Hindu Personal Laws to non-Hindu Personal Laws and suggested to incorporate the "best ideas and principles" of each of the Personal Laws into it. +++ ------------------------ Yahoo!
