Not necessarily. Clearly Rumsfeld's role was materially different than the
various members of Congress, so the standards for prosecution would be
different.

If you said "if you prosecute one member of Congress who had been briefed
and signed-off, you'd have to prosecute them all" I'd be in total
agreement.

And mind you, I'm not saying there aren't Congress-critters who ought to
be held to account (I just don't know what their involvements were beyond
possible briefings), just that their role was quite different from
Rumsfeld's, obviously.
