You might want to double-check exactly what you need to write. It
*used* to be that "(C)" was not sufficient for indicating copyright
You needed either to have a c within a circle or to have spelled out
"copyright" in its entirety.
Bottom line...if it's really important, it's worth the upfront cost to
get advice from an intellectual property attorney.
There are also many sites around that quote the exact laws. Any
search engine should be able to find a half dozen of these.
As you mentioned, if you have not registered your copyright, you can
only sue for actual damages in the States. Once registered, you can
also sue for punitive damages for copyright infringement.
