The real fun begins when people start challenging you on trademarks and patents. I've had the joy of dealing with both. Why can't the world just leave us bitheads alone to create interesting algorithms out of single lines of C code?!? Next thing you know they'll be telling us that caffeine and sleep deprivation are bad for us. What's the world coming to?

Someday I'm going to write something so cool that the world just can't live without it. When I do, I'm going to license it in such a way that it's only usable on Tuesdays by red-headed persons named Brunhilda. *sigh* Such a tangled web of legalities, and all we want to do is write software that works well and makes life easier for people. Your advice, Mark, is the best that anyone can really offer. If it matters, talk to a lawyer. Of course, if you're writing an on-board registration key cracking suite, you probably don't need to worry about whether you're swiping someone else's intellectual property. There are places out there where experts have debated all of these points, and anyone looking for reliable information might want to check out: http://www.intelproplaw.com/ There *seems* to be a wealth of credible information there, maintained by an actual IP attorney, and I find the forums especially interesting -- but I'm not a very good judge of what's credible and what isn't; caveat emptor.
