What the police will really be looking at in their investigation is which of the circumstances, or combination of circumstances led to her death. A key issue will be whether he noticed she was in physical distress and tried to do anything about it, time of death vs time the authorities were notified she was deceased. It is entirely possible he could walk out of this with a few minor drug and paraphernalia charges. It looks bad for him now, but it's usually the policy of law enforcment agencies to investigate all unattended deaths or deaths under unusual circumstances as homicides. Doesn't necessarily mean it is.
