I have a Bogen 3011, and it does the same thing. It's only about 1-1/2 years old, and I bought it new. It has the thumbscrew-type leg tighteners, and I almost get my thumb out of joint trying to tighten the legs enough so that it doesn't "sink" while I'm taking a photo. Every time I use it I end up saying, "I hate my tripod." My friends don't seem to have the trouble that I have, and most of them have Gitzo tripods. I guess I have to live with it for awhile also, but maybe someone has a solution about how to fix this.
