John, you should join a union or a photographers assocoation. I'm sure they would be able to offer you necassary leagal assistance, in matters like the one you describe. Jens

Last weekend my wife and I went down to the Monterey Historics. She picked up a copy of the event program, which had a rather nice cover showing a Ferrari 512 in the corkscrew (the same picture was also used on the promotional poster for the event). I knew I'd got a similar photograph from a couple of years ago, so I eventually dug it out to put the two images side by side. They were more than similar; they were practically identical! The program cover (which was composite artwork) had a different background, and there were a few differences on the details of the driver. But the main features of the image (the angle of view of the car, the position of the shadow on the trackside, and the position and content of the highlights and reflections on the bodywork) were exactly the same. I don't see any way the cover art could be based on anything other than my image. I'm a little annoyed, because I'd have liked to be credited. I don't mind the track using my image for their publicity, but if the artist gets a credit I feel I should get one too. I've sent email to the artist (and to the track pr contact) to try and get some details. I'm fairly sure the track had an 8x10 copy of the shot, but I'm certain that if that were the case the print would have had my copyright shown on it, just as that information is on the print I made for myself. At present I believe they've used my image without proper credit - I'm waiting to see if they have any alternative explanation for the "similarity" between the two images.
