I guess a more applicable question might be if J. Random Foreigner writes something that could be considered illegal speech in his own country, but sends it to a list server in a country where his words would be protected, who's laws apply? Or rather, who's laws should apply?
J. Random Foreigner's country can do what they will with him. They're going to anyway.
