Actually, he was standing ~behind~ a plexiglass bus shelter - the "no smoking" signs are for inside the shelter. Of course, you can't really tell any of that from the photo. He's in a completely legal smoking zone, but I have to admit, one of the things I liked about the photo is that it looks like he's not. ;-) FYI, he had a smoke in one hand and a coffee in the other.
