It's clear that the concept was copied.  I also think the "copy" image is better than the 
"original".  However, I think the judge in this case is a bit off the mark.

I'd say lets be fair, but no I don't want to be fair and I don't believe this idiot of a judge deserves fairness, he has no understanding of reality or the law. Judicial decisions such as these are one of the many reasons the law falls into disrepute.
