FBI ARRESTS NATIONALIST-LEADER ALEX CURTIS

This afternoon, Alex Curtis, well-known Racial Activist from San Diego
California was arrested by FBI Agents at his home. At this time I am not
sure of the charge. I will give further information as time passes. Curtis
is being held at the downtown Federal detention Center in San Diego.

The FBI raided the Curtis Home this afternoon Thursday carrying away all
books, computers and records. More will follow.

I suggest heightened security precautions at this time since it is never
known if a general sweep has begun. Please report any Federal contact ASAP.

Officials have conducted yearlong investigation; arraignment Monday

White supremacist Alex Curtis was arrested at his Lemon Grove home
yesterday on suspicion of federal hate crimes after a yearlong
investigation. Critics label the 25-year-old as "a rising star" in the
racist movement on a national level.

FBI agents and San Diego police arrested Curtis about 3:45 p.m. They took
him to the FBI office in Kearny Mesa for questioning, then booked him into
federal jail downtown. An arraignment is scheduled for Monday.

A sealed indictment handed down by the U.S. District Court yesterday
alleges several hate crimes and civil rights violations, FBI spokeswoman
Jan Caldwell said. She declined to detail the allegations yesterday.

San Diego police Chief David Bejarano, U.S. Attorney Gregory Vega and San
Diego FBI Chief Bill Gore are scheduled to announce the arrest at a news
conference this morning.  The Southern Poverty Law Center, a watchdog group
based in Montgomery, Ala., has named Curtis one of the six most prominent
young hate leaders in the country.  The Anti-Defamation League considers
him "a rising star among bigots." Local spokesman Morris Casuto said
increased police attention to hate crimes reflects the potential threat by
such individuals to the community.

In his zeal to create an all-white nation, Curtis encourages individuals to
violence.

"I attack my enemies, such as the U.S. government and Jews, without
compromise," Curtis recently told a San Diego Union-Tribune reporter
through e-mail letters.  He also staunchly advocates terrorism by single
attackers.

Curtis described himself as having few friends and working occasionally at
minimum-wage jobs.

Like other nationally known white supremacists, Curtis favors modern
technology to spread his message rather than old-fashioned rallies.

 From his parents' house, Curtis publishes a racist magazine and runs a Web
site. He also updates daily a telephone hotline with race-related news from
around the world.  He told a reporter that his parents don't share his
views. Last night, a friend at the Curtis home said the family did not want
to talk about the arrest.

When Curtis was a student at Helix High School in 1993, he was expelled
after being linked to vandalism of two classrooms decorated in part to
honor minority writers and soldiers. The teachers arrived to find swastikas
painted in the rooms and phrases such as "The Ku Klux Klan is watching and
we're not happy about what we see."

In 1997, Curtis was convicted of using a La Mesa Police Department insignia
on 1,000 hate fliers distributed in La Mesa.

Bay Area Holocaust lawsuit targets Vatican Bank and CIA

In a fight to win restitution for people like 84-year-old Allan Herskovich
of El Cerrito -- a native of what was formerly Yugoslavia who lost his
parents and other family members at Auschwitz -- two lawyers are taking on
a couple of formidable opponents, the CIA and the Vatican Bank.

Tom Easton and Jonathan Levy, who represent Herskovich and 27 other
plaintiffs in a lawsuit filed last year, continued their push two weeks ago
by asking a federal judge in San Francisco to get the Vatican Bank to
divulge its ownership.

A hearing on the ownership question had been set for Oct. 31 in San
Francisco, but the defendants requested leave to prepare over-length briefs
of up to 40 pages, asking that the lawsuit be dismissed. Those briefs will
be filed by Nov. 10. The plaintiffs have requested extra time to answer
these over-length briefs and a hearing is not expected for several months,
according to Easton, who is based in Bend, Ore.

In August, Easton and Levy, a Cincinnati attorney, filed a related lawsuit
against the CIA and the U.S. Army to obtain access to some 250 papers they
say will reveal important information about who wound up with assets that
were stolen from Holocaust victims.

Easton and Levy contend that the Vatican Bank and other private banks
profited illegally from the Holocaust by accepting and laundering valuables
stolen by the Nazis and the Nazi-backed Ustashe regime, which went on a
reign of terror in Yugoslavia.

The Vatican Bank and the Franciscan Order were named in the original
lawsuit, which was filed in U.S. District Court in San Francisco in
November 1999. In September, a federal judge ruled that the Swiss National
Bank could be added to the lawsuit.

Plaintiffs' lawyers say restitution for thousands of Ustashe regime victims
and their heirs could amount to "hundreds of millions of dollars."

All of the legal wrangling seems to be too much to digest for Herskovich,
who still runs the electric shaver shop he opened in Richmond in 1957.

"All I know is that I've never gotten a nickel [in restitution] from
anybody," said the man who went on to open 13 other shaver shops around the
Bay Area.

In Zagreb, now Croatia, Herskovich's father owned a textile manufacturing
business that his lawyers contend was valued at $1.5 million prewar U.S.
dollars by Yugoslavia's communist government in 1948. However, most of the
family's property was looted.

"I see people getting [restitution] from many different countries, but I've
never gotten anything," Herskovich said. "I don't know one fellow who came
from my country who has gotten anything."

Herskovich is one of several Bay Area residents and native Yugoslavs named
in the class-action lawsuit.

The others are David and Zdenka Baum Ruchwarger Levy of San Mateo; Fred
Zlatko Harris of Pleasant Hill; and a non-Jew from Berkeley, Desa Tomasevic
Wakeman, a Serb who spent time in a concentration camp near Zagreb and lost
family in the diabolic Jasenovac death camp.

Easton and Jonathan Levy contend that gold, silver and jewels plundered
from Jews and others in Croatia and Bosnia -- mainly Serbs and Roma/Sinti
people (formerly referred to as Gypsies) -- went from the hands of the
Ustashe into the Vatican Bank and other financial institutions.

The lawyers' inquiries center on Father Krunoslav Draganovic, a Croatian
Catholic priest who was a member of the Ustashe, a nationalist movement
that ran the country under Nazi occupation.

Draganovic, who died in 1983, is believed to have stolen millions of
dollars in loot. Soon after the war, he moved to Rome, established ties
with the Vatican and its bank, and, while using a seminary as a front, ran
the infamous "ratline," an escape route to South America for Nazi war
criminals.

Draganovic was also in the pay of the CIA for several years, Levy contends.
He and Easton are seeking CIA and Army documents that reveal new details of
Draganovic's career.

Other documents, he said, will show that without the help of Britain and
the United States, the Ustashe would have been destroyed. He contends that
Western intelligence helped propel former Ustashe members into positions of
influence in countries such as Argentina, Paraguay and Venezuela.

"The documents, even the ones we have now, are very troubling," Levy said
recently. "What's been released looks like it's just the tip of the
iceberg."

Levy said the CIA files have been withheld on the grounds of national
security, to which he added, "It's just incomprehensible that there are any
national security issues on records that are 40 or 50 years old."

He expects a settlement soon in which the CIA and Army hand over some, if
not all, of the requested records.

The other part of Levy's fight right now is the lawsuit against the Vatican
Bank.

In responding to the plaintiffs' motion for disclosure of ownership, the
Vatican Bank said in court papers that the motion was "burdensome,
premature and in the public domain," according to Levy.

"Who owns it is very important in the way the lawsuit proceeds," he added.
"It's a very mysterious organization. In their legal papers, they quoted an
Italian professor saying there are 30 sources that say what the ownership
of the Vatican Bank is, but he didn't list a single one."

Levy said the owner might always be the current pope, in this case Pope
John Paul II. "If that's the case, then we'd have to determine in what
capacity the pope owns the bank," Levy said. "Or maybe their charter lists
God as the owner."

In any case, the question of ownership will not be answered soon. The
Vatican Bank's motion to dismiss, on six different counts, will likely put
that request on the bank burner. A hearing on the motion to dismiss will
then be scheduled several months down the line.

PARIS, France -- In the latest step in a legal battle over racism in
cyberspace, a team of Internet experts told a judge Monday that it was
possible to block some French Web surfers from U.S. giant Yahoo!'s auction
site, though one specialist expressed concern about Net freedom.

The trans-Atlantic case began nearly seven months ago, when two Paris-based
anti-racism groups sued Santa Clara, California-based Yahoo!, angry that
French people had access to more than 1,000 objects of Nazi memorabilia on
the site at auctions.yahoo.com.

The groups, the Union of Jewish Students and the Licra anti-racism
organization, argued that Yahoo! was breaking the law in France, where it
is illegal to sell or display objects that promote racism.

A Paris judge ordered Yahoo! to pay fines to the two groups, and later
asked a team of experts to search for ways to filter French users from the
site and all other sites deemed racist.

Yahoo!'s lawyers have argued that it would be impossible to keep French
people off the site, as cyberspace has no borders. The company is also
worried the case could set a global precedent that would leave Web sites
vulnerable to legal attacks from abroad.

In Paris on Monday, three technology experts said the Yahoo! site could
indeed be partially controlled -- but at least one of the specialists
expressed caution about setting such a precedent.

After months of research, French expert Francois Wallon and American Vinton
Cerf testified that it would be possible to detect 70 percent of Web
surfers who use an easily identifiable French Internet service provider to
access the auction site. Britain's Ben Laurie was also on the team but was
unable to attend the hearing.

"Identification would be more difficult for the other 30 percent who use an
international access provider such as AOL," Wallon said. The experts
suggested that users be required to fill out an online form stating their
nationality -- while recognizing that people could easily lie.

Cerf, a founding father of the Net, expressed doubts about whether such
attempts were worthwhile.

"The Internet is very open, and all technical solutions are permeable,"
Cerf said. "Those who want to reach a blocked site will learn how to bypass
the keywords that block it."

But the experts said that attempting to block every racist site from French
users would clearly be impossible.

"There are 100 million Internet sites in the world," he said. "In five
years, there will be a billion. Even if we only block some of them, the
list is long. And if we block too many of them, we risk blocking the whole
system."

Paris Judge Jean-Jacques Gomez is expected to rule on the case November 20.

Panel: Yahoo! can block access to Nazi items -- Experts say portal can
     block French users from accessing U.S. auction sites.

PARIS -- Yahoo! has the technical means to prevent French Internet users
from accessing its U.S. auction sites that trade Nazi-era items, a panel of
experts including Vinton Cerf, the man widely regarded as the "father" of
the Internet, told a Paris court.

The experts outlined a method they said can block French users' access to
the sites in 70% to 80% of cases.

The court will rule on the six-month old case Nov. 20.

The Tribunal de Grande Instance ruled in May that Yahoo! must "take all
necessary measures to prevent the sale of Nazi objects on all French
territories." It appointed the panel in August to help determine whether
the Santa Clara, Calif.-based company could technically prevent such access
from abroad.

"It's very simple to filter a query containing key words, such as 'nazi,'
if users are identified as coming from France," Francois Wallon, the French
court-appointed expert said at Monday's hearing.

Anti-racist groups have asked the court to enforce a French ban on the sale
and trading of items glorifying Nazi Germany. The case pits advocates of a
self-regulated Internet against those who argue national laws should also
apply to the Web.

Not fool-proof

Some panel members, however, disagreed as to whether the method, although
technically feasible, would be sufficient.

"Such a technique is either too narrow or inadequate," Cerf told reporters
after the hearing. "This isn't foolproof It would be a slippery slope."

As a researcher in 1973, Cerf was instrumental in developing the Internet's
architecture. He now works as senior vice president for Internet
architecture and technology at WorldCom, the second-biggest U.S. long-
distance phone company.

The experts said about 70% to 80% of French Web users can be recognized
through their IP, or Internet protocol, address. The filter would act to
prevent those users from opening Yahoo!'s auction site if the users input
previously defined keywords.

Yahoo!'s French Web site doesn't allow Nazi items to be traded. But Nazi-
era memorabilia are found on Yahoo!'s U.S. site, including flags, stamps,
military items and speeches.

The third panel member is Ben Laurie, a technology expert from the U.K.,
who was not present at the hearing.

The Paris-based International League against Racism and Anti-Semitism filed
the complaint along with the Union of Jewish French Students and the
Movement Against Racism and for Friendship Between Peoples.

Yahoo! shares fell as much as $3.37 to $65.37.

Nazi bans in Europe do not sway auction sites

Auction site Sold.com.au has no plans to remove Nazi memorabilia from sale
despite a French court battle between Yahoo and two Paris anti-racist
groups over the issue.

Sold.com.au, the online auction arm of Fairfax's f2, had nine Nazi items
for sale yesterday, including a swastika banner, Nazi coins, stamps
depicting Hitler, a kapo armband (a kapo was a prisoner who oversaw other
prisoners) and SS dog tags and tie pins.

The coin and stamp set has drawn the greatest number of bids while, with an
opening price of $195, the Nazi banner is the priciest item.

Meanwhile, eBay.com.au, the US online auction giant's local site, has 14
Nazi items for sale, including Nazi death cards, a sword presented by
Heinrich Himmler and SS shoulder tabs and armbands.

An offended Jewish Sold.com.au customer said he complained to Sold but as
yet had received only a routine reply e-mail from its customer service.

Sold.com.au chief executive Mr Martin Hoffman said that while the site did
not go out of its way to promote "those sorts of things", it took the view
that "if it's legal to be sold then it's fine for it to be auctioned
online". He said he knew of no complaints from Sold.com.au customers.

Mr Hoffman said there were different laws over the sale of Nazi memorabilia
in European countries.

Last Monday the case between Yahoo and anti-racism groups continued with a
team of Internet experts telling a Paris judge it was possible to block
some French Web surfers from Yahoo's US auction site. Yahoo had argued that
this was impossible.

The transatlantic case, to resume on November 20, began seven months ago
after the Union of Jewish Students and the Licra anti-racism organisation
sued Yahoo, angry that French people could access more than 1,000 Nazi
objects on the site. They said Yahoo was breaking the law in France, where
it is illegal to sell or display objects promoting racism.

Mr Danny Ben-Moshe, executive director of the B'nai B'rith Anti-Defamation
Commission, said there was an "extra onus" on auction sites to regulate
sale items to better prevent such material from falling into the wrong
hands.

"We know that the neo-Nazism movement focuses heavily upon Nazi memorabilia
and imagery in terms of winning recruits and the reality is that this sort
of stuff feeds this process," he said. "The Internet makes these peoples'
lives a whole lot easier in that regard.

"This sort of material needs to go to places like museums where it can be
put in its proper historical context."

EBay Australia marketing director Mr Bay Warburton said while illegal items
such as body parts and drugs were not allowed, Nazi items were assessed
according to their historical value and worth as genuine collectables. "So
as long as something's at least 50 years old and is not being used to
glorify or promote, then it's okay. A 1980s neo-Nazi T-shirt would not be
acceptable, for instance."

a tale of two Pakistani families - one a victim of a bizarre racist attack
and another a victim of an equally bizarre act of violence against itself.
Though the incidents happened sometime ago, their perpetrators had their
comeuppance only Wednesday when the courts found them guilty and sentenced
them to life imprisonment. In one of the most vicious cases of racism,
which has raised questions about the safety of non-white prisoners, a
Pakistani teenager was bludgeoned to death by his white cellmate after
heaping racial abuses on him. Wahid Mubarek, 19, was charged with
shoplifting early this year, and sent to a young offenders' institution in
Feltham to serve a 90-day sentence. He was put in the same cell as Robert
Stewart, 20, who had a history of violence and has since then been
described as a "racist psychopath". It has turned out that he used to write
letters threatening immigrants saying they had taken over the country; and
apparently prison officers knew about this, thanks to a system of censoring
all outgoing prisoners' mail. On March 21, the day Mubarek was to be
released and his family was preparing to welcome him back, Stewart attacked
him with a table leg while he was sleeping and bludgeoned him to death.
When the body was found, he said Mubarek had had an accident, though later
he admitted that he had killed him, but that he didn't know why."
