That's a good question, and I am personally not qualified to give an
answer (I'm not a lawyer). I think the more interesting point to make is
that, given the other repositories available, ActiveState doesn't really
have to. Randy ( and crazyinsomniac, and bribes.org ) are able to fill
in the gaps for us.

This is where I would like to put credit where credit is due. By far the
most useful ting you can use related to ppm / Win32 is not on ActiveState's
site, it is Randy's CPAN search engine:

We're looking seriously at replicating this sort of functionality on
ASPN down the road, and I admit this is the sort of thing that should
have been done by us up-front to support ppm technology. Randy makes my job 
much easier to do by providing this service.
