Students� do you have general questions about the immigration process or
have a specific interest in learning more about what is involved in
petitioning for an H-1B (U.S.) visa?

The H1-B nonimmigrant visa category was established for foreign workers in
"specialty occupations" and "fashion models of distinguished merit and
ability." Generally speaking, a "specialty occupation" is a professional
position requiring:


a "theoretical and practical application of a body of highly specialized
knowledge," and;
the "attainment of a bachelor�s degree or higher degree in the specific
specialty (or its equivalent)."

Significantly, H1-B workers may obtain full time permanent positions in the
United States, provided, however, that the worker leave the United States at
the end of the authorized period of stay, including any extensions of stay.
H1-B visas generally provide for three years of employment, with a potential
extension of up to three years for qualified candidates. Also of importance
is the fact that H1-B workers do not need to keep a foreign residence during
their period of stay in the United States. H1-B candidates may, however,
seek permanent residence status (green card) while petitioning for or
holding H1-B status. Thus, candidates seeking to live and work in the United
States on a permanent basis can use the H1-B as a starting point for their
career.

Be aware that the availability of H1-B visas is limited by a yearly quota,
and although this quota has been increased recently, even the new quota is
not likely sufficient to meet future U.S. labor demands. As a result, it is
a good idea to gather all available information needed for your petition at
your earliest convenience so that when the time comes to actually file a
petition, you will be ready to move quickly and efficiently. Some of the
necessary information you will need is listed below:

Copies of academic degrees.
Copies of academic transcripts (if needed).
Degree equivalency evaluation for foreign degrees.
Copies of licenses to practice the "specialty occupation" (if applicable).
Letters from past employers documenting relevant experience.
Documents proving experience equivalency (if necessary).

Finally, although many students feel the immigration process will limit
their chances for U.S. employment, if you have a working knowledge of the
visa process, and are prepared to act immediately when you have a job offer,
you can effectively limit, if not eliminate, any significant immigration
burdens to your candidacy.
